Public schools that offer distance learning and computer-based courses of study shall provide accompanying electronic formats that are usable by a person with a disability using assistive technology, and those formats shall be based on the American standard code for information interchange, hypertext markup language and extensible markup language.

Laws 2003, ch. 143, § 2, effective July 1, 2004, and contingent upon adoption of an amendment to Article 12, Section 6 of the constitution of New Mexico, repeals Articles 1, 2, 13, 13A and 15 of Chapter 22 NMSA 1978. The constitutional amendment was approved at the special election on September 23, 2003, giving the repeal full force and effect as of July 1, 2004. However, as this section was not within the scope of the repeal by Laws 2003, Chapter 143 at the time of that act’s passage, this section would appear not to be repealed on July 1, 2004.
Laws 2007, ch. 292, § 11 and Laws 2007, ch. 293, § 11 recompiled 22-13-27 NMSA 1978 as part of the Statewide Cyber Academy Act. Section 22-13-27 has been recompiled as 22-30-7 NMSA 1978.
