File:  GDCA - Support Staff Sick Leave

Each work year, support staff shall be granted one (1) sick day for each month of employment or portion thereof, up to twelve (12) days, based on full-time equivalency. Sick leave shall be earned at a rate of one (1) day per twenty (20) days worked.

The first two days of earned sick leave for each employee shall be applied toward the sick leave bank.

Sick leave shall be approved by the support staff member's immediate supervisor.

Sick leave may not be used for travel time for out of state routine medical service.

Sick leave can only be used in instances of illness, injury, short-term disability related to pregnancy, maternity or paternity leave, and other uses allowed under the Colorado Healthy Families and Workplaces Act.

A support staff member taking sick leave may be required to verify the illness or injury by furnishing a medical doctor's statement or certificate. Abuse of sick leave shall be grounds for discipline and may be grounds for dismissal.

A support staff member who is unable to report for work at the beginning of the school year because of an illness or disability shall not be credited with sick leave for that year until they have returned to work. Upon return, the support staff member shall be credited with an adjusted sick leave allowance which shall be used to diminish any deductions sustained for the absence.

While on any type of leave permitted by Board of Education policies, a support staff member shall retain but not accrue additional sick leave except as otherwise indicated.

A support staff member who is absent due to serious illness in their immediate family as defined by the Family and Medical Leave Act of 1993 and its implementing regulations) may have such absences charged to their available sick leave. A support staff member who is absent due to death in their immediate family or spouses' immediate family may have such absences charged to their available sick leave.

For each actual workday a support staff member is absent after their sick leave is exhausted, a deduction shall be made from their next regularly scheduled paycheck in the amount equal to their hourly rate of pay multiplied by the number of actual work hours missed.

A support staff member who separates (termination or resignation) from the District before the end of the year who has used more sick leave than earned in the fraction of the year worked shall have the appropriate amount deducted from their final paycheck.

A support staff member who separates (termination or resignation) from the District after at least five (5) full years of employment shall be compensated for unused sick leave days up to a maximum of ninety (90) days. at a rate depending on their years of employment in the District, according to the following schedule:

Banked Sick Leave

Sick leave earned prior to June 30, 2007, falls under a legacy clause and will be known as "banked" sick leave" that will be paid as follows:

*Sub rate is the bottom or entry-level hourly rate of the support staff member's salary bracket, which shall be based on the salary schedule for 2005-06.

Amount of Leave to be Paid:

Upon separation (termination or resignation) of employment, unused sick leave will be paid as follows at the above rates:

•  If a support staff member's "banked sick leave" (sick leave accumulated before June 30, 2007) balance equals or exceeds ninety (90) days, the "banked sick leave" will be paid in its entirety and no "sick leave" (sick leave accumulated after June 30, 2007) will be paid.

•  If a support staff member's "banked sick leave" (sick leave accumulated before June 30, 2007) balance is less than ninety (90) days, a maximum of ninety (90) days of sick leave will be paid which will include the entire "banked sick leave" balance plus the amount of "sick leave" (sick leave accumulated after June 30, 2007) up to a maximum of ninety (90) paid sick days.

•  If a support staff member has no "banked sick leave" (sick leave accumulated before June 30, 2007), their "sick leave" (sick leave accumulated after June 30, 2007) balance will be paid up to a maximum of ninety (90) days.

When sick leave is used, the oldest earned sick leave is used first. Therefore, "banked sick leave" will be used before sick leave earned after June 30, 2007.

Any additional leave granted by the Board of Education for sick leave purposes shall be without pay or other benefits unless specifically approved by the Board or required by state or federal law.
