Overtime

The administration shall determine which School District employees are subject to the minimum wage and overtime requirements of Federal law.  These non-exempt employees shall be paid overtime at the rate of one and one-half times the regular rate of pay for hours worked in excess of 40 in any work week.

Alternatively, in lieu of overtime compensation non-exempt employees may receive compensatory time off at a rate not less than one and one-half hours for each hour of employment for which overtime compensation is required.

Regulations

1.    Overtime shall be defined as those authorized hours worked in excess of an employee's regular forty (40) hour work week or twelve (12) hours in a day.

2.    Payment will be made to compensate employees for time worked beyond the regular 40 hour work week or the 12 hour work day through either compensation or compensatory time.

Compensation for overtime shall be calculated as follows:

  Overtime payment for time worked that does not exceed a 40-hour work week or the 12-hour day shall be calculated at straight time.

   Time worked is defined as actual time worked and does not include holiday time or any type of leave.

  Overtime payment for time worked above and beyond the 40 hour week or the 12 hour work day shall be paid at time-and-a-half.

  Any time worked beyond an 8 hour day shall not be calculated at time-and-a-half unless the staff member has worked over 12 hours for the day or 40 hours during that work week.

  Support staff members working in more than one regularly scheduled position will earn an over time rate that reflects a blended (average) rate of all support staff positions s/he is regularly scheduled in.

Compensation for Compensatory time (Comp time) shall be calculated as follows:

   Time-and-a-half the time worked beyond the regular 40 hour work week.

  Time worked is defined as actual time worked and does not include holiday time or any type of leave.

   Straight time if the time worked beyond the regular work week is less than forty hours.

3.    Authorization for overtime payment must be obtained from the employee's supervisor prior to the time the overtime is to be worked.

A determination as to whether overtime shall be compensated through pay or through compensatory time shall be made by his/her supervisor prior to the performance of the work.

Overtime will not be authorized unless there is a sufficient amount of money in the account to pay for that overtime.

4.    All overtime work shall require the advance approval of the employee's principal and/or other immediate supervisor.  An effort shall be made whenever possible not to schedule non-exempt employees for more than 40 hours per week.

5.    District employees who put in extra hours to supervise and/or serve community groups using school facilities shall be paid at the rate established by the Board for such contract services.

6.    Compensatory Time (Comp Time)

   Comp time will be documented in the District time keeping system.

  A maximum of 40 hours of comp time can be accumulated at any given time. 

  Comp time earned must be taken (with the approval of his/her supervisor) within the same fiscal year which is July 1st through June 30th.

  Requests to use comp time shall be granted if the use of the comp time does not unduly disrupt the operations of the School/Department and/or School District.

  Comp time not taken will be paid out as of July 15 th of each year.

  Supervisors have the flexibility to require the use of earned comp time.

  The Supervisor has the flexibility to apply department/school rules surrounding use of comp time.
