File:  JFAA-R - Admission of Resident Students

Proof of residence

All students must present one of the following documents in order to prove residency in the Summit School District RE-1:

1.  A warranty deed, closing statement or settlement statement on the purchase of a home in the district.

2.  A lease or rental agreement of a home within the district.

3.  Any other proof acceptable to the district showing legal residence.

Students residing with a legal custodian

When students under the age of 18 are living with someone other than their parents, the person with whom they are making their home must obtain a delegation of custodial power in order for the student to be admitted as a resident of Summit Schools.  The custodian must reside in the district.  This custodial form does not transfer legal custody of the student.  The authority of the custodian will be effective only for the school year in which the delegation of custodial power is executed.  In the absence of a court order, the following procedure must be followed:

1.  Submit a Delegation of Custodial Power by Parent or Guardian form (see JF-E-2).

2.  The prospective custodian must be at least 21 years of age.

3.  The Delegation of Custodial Power by Parent or Guardian form must be completed by the custodial parents.

4.  Prior to enrollment, the original Delegation of Custodial Power by Parent or Guardian form must be approved by the superintendent and delivered to the principal.

Students adopting residence other than that of parents

A student who adopts a dwelling place within the district where he/she will regularly eat, sleep or both during the entire school year, whose intent is to remain at that dwelling indefinitely and whose intent is to not return to the dwelling place from which he/she came may be eligible to enroll and attend school as a resident student.  The student will be deemed not to have such requisite intent if he/she regularly returns to another dwelling place during summer vacations or weekends.  To determine a student's intent, the district may look at any other factor that tends to show the student's intent.

Questions to ask to establish if a student meets residency requirements

The following questions will be asked to determine if students meet the requirements for residency:

1.   Applicant's name, address and telephone number.

2.  Name, address and telephone number of each of applicant's parents or guardians.

3.  Name of and relationship to applicant's closest relative residing at the same location as applicant.

4.  Name, address and telephone number of any person at whose place of residence applicant resides during the calendar year, other than that listed in number 1 above and the period of time that the applicant resides at that place.

5.  Evidence showing the applicant's custodial parent(s) or legal guardian(s) such as custody agreement court order, birth certificate, etc.

6.  Evidence showing parents' or legal guardians' residence such as home ownership, voter registration, vehicle registration, place of employment, etc.

7.  If applicable, any information showing that applicant's residence is different from that of parent or legal guardian.

8.  Evidence showing location of applicant's residence such as evidence showing emancipation of applicant, etc.

9.  If applicable, evidence describing circumstances of applicant's separation from parent(s) or legal guardian(s).

10.  A statement from parent(s) or legal guardian(s) designating the individual, if other than himself, locally present in the School District who is authorized to approve and/or direct emergency medical treatment or make decisions and determinations regarding school matters such as discipline, curriculum and activities.

11.  Evidence showing parent's or guardian's place of employment.

12.  Place at which applicant will spend Thanksgiving, Christmas, summer and other school vacation periods.
